After Mediation has Been Completed

If your case settles in mediation, Jeff will report back to the court (if the case has been filed) that the parties mediated the case and the case settled. Jeff will also advise the court that the parties will forward the appropriate dismissal and/or non-suit documents to the court for entry. Typically, the court likes to receive dismissal documents within 30 days of the mediator’s report that the case settled.

If your case does not settle, Jeff will report back to the court (if the case has been filed) that the parties mediated the case and that the case did not settle. Jeff will not disclose any demands made by the Plaintiff or any offers of settlement made by the Defendant. Jeff will not discuss the demeanor of the parties or counsel or any facts learned at mediation. Jeff will also invite the parties and their counsel back to mediate at a later date after further discovery is conducted or more information is exchanged.

Jeff remains committed to working with the parties and their counsel even after a failed mediation. He will make himself available for additional phone calls, read additional materials and will continue to be engaged with each side until he determines that there is little to no chance of resolving the parties’ case.
